County Clerk

The County Clerk is an elected position with duties set out statutorily in the Texas Constitution as follows: Article 5, Section 20 - COUNTY CLERK : "There shall be elected for each county, by the qualified voters, a County Clerk, who shall hold office for four years, who shall be clerk of the County and Commissioners Courts and recorder of the county, whose duties, perquisites and fees of office shall be prescribed by the Legislature…"

TERESA KIEL is the County Clerk of Guadalupe County, Texas, which is located approximately one hundred miles inland from the Gulf of Mexico in south central Texas and is a component of the San Antonio Area Metropolitan Statistical Area. The County population is approximately 150,000 and continues to be one of the fastest growing areas in the state.

    The State of Texas requires Marks and Brands be re-registered every 10 years. Current marks and brands will expire on August 30, 2021. Renewal begins August 31, 2021.

  • Fraudulent Filing

    Pursuant to Section 51.901 of the Texas Government Code:

    If a county clerk believes in good faith that a document filed with the county clerk to create a lien is fraudulent, the clerk shall:

      (1) request the assistance of the county or district attorney to determine whether the document is fraudulent before filing or recording the document;
      (2) request that the prospective filer provide to the county clerk additional supporting documentation; and
      (3) forward any additional documentation received to the county or district attorney.


    Pursuant to Section 37.101 of the Texas Penal Code:

     (a) A person commits an offense if the person knowingly presents for filing or causes to be presented for filing a financing statement that the person knows:

      (1) is forged;
      (2) contains a material false statement; or
      (3) is groundless.

     (b) An offense under Subsection (a)(1) is a felony of the third degree, unless it is shown on the trial of the offense that the person had previously been convicted under this section on two or more occasions, in which event the offense is a felony of the second degree. An offense under Subsection (a)(2) or (a)(3) is a Class A misdemeanor, unless the person commits the offense with the intent to defraud or harm another, in which event the offense is a state jail felony.

    Effective November 1, 2020

    The County Clerk’s office will only accept one original plat for recording (paper only).

    One (1) certified copy will be supplied to the customer at no charge at the time of recording.

     

     

    The County Clerk's office requests that you reserve a 3" x 4" area in the lower right hand corner in order for us to properly place our recording information. Effective immediately, if we receive plats that do not have the required space for recording information, the plat will be rejected.
